The Top Argument From The Left: The Supreme Court Turns the President Into a King, Holly Brewer, The New Republic: “Five members of the Supreme Court of the United States want to take us back to seventeenth-century absolutism. In a stunning rejection of originalist interpretation, and in defiance of the single statement carved onto the front of the majestic building where they work (‘Equal justice under law’), the justices ruled Monday that the president does not have to abide by the laws of the land. They agreed that presidents might be liable for purely private acts, such as Bill Clinton lying about engaging in oral sex in the Oval Office. But in the appropriately titled Trump v. the United States, they have narrowed the scope of possible prosecution so dramatically that in effect Donald Trump cannot be held accountable for almost any of his efforts on January 6, 2021, to retain power beyond his term. The result, as Justice Ketanji Brown Jackson wrote in her dissent, is that the court has created a paradigm shift: ‘The Court has unilaterally altered the balance of power between the three coordinate branches of our Government as it relates to the Rule of Law, aggrandizing power in the Judiciary and the Executive.’ The 6–3 majority—five of them in particular—created a ticking time bomb that ignored the Constitution’s most fundamental principles, making it easy for future presidents to become dictators and act with impunity.”

The Top Argument From The Right: Supreme Court strikes proper balance on presidential immunity, Washington Examiner: “As prosecutors nakedly abuse the powers of their office for partisan purposes, the Supreme Court’s decision to extend criminal immunity to a president’s official acts is prudent. … With lawfare now a routine means of weakening political opponents, the court’s 6-3 majority in Trump v. United States struck the right balance, extending the immunity presidents already enjoy in the civil context, which all nine justices support, to the criminal context. Critics of presidential immunity are right when they say there is no ‘presidential immunity clause’ in the Constitution. But there is no separation of powers clause either and yet that legal concept has been a guiding principle of constitutional law since the Supreme Court’s first decision. … Justice Sonia Sotomayor argues in dissent that giving a president immunity for official actions but not unofficial ones would let presidents ‘feel empowered to violate federal criminal law.’ The majority saw this as ‘fear mongering’ and we agree. The majority notes that under its holding, after further fact-finding by the lower court, former President Donald Trump can still be prosecuted for his efforts to create slates of alternative electors. Under this ruling, no one is above the law.”

Americans Disagree

Before the Supreme Court’s ruling, polling found that an overwhelming majority of Americans (70%) believed any president should not have immunity for actions taken in office, and the remaining 30% supported immunity for presidents.

Regarding Trump specifically, 38% of Americans believe he should have immunity while 62% say he should not. However, those numbers shift significantly among Republicans, with 45% favoring immunity for any president and 67% favoring immunity for Trump (CBS News).
