Trump Indicted

Last week a Manhattan grand jury voted to indict former President Trump in connection to a 2016 payment made to porn star Stormy Daniels, allegedly in exchange for her silence about an affair. This marks the first time a former president of the United States has faced criminal charges.

From The Flag: Prosecutors say Trump made the payment in order to protect his presidential campaign, and therefore committed a felony by classifying the payment as a legal fee. Trump has denied he ever had an affair with Daniels and says this is a political prosecution that amounts to election interference. Here’s more from both sides.

An Outrageous and Confusing Case, Driven By a Clear Obsession

  • This is a fundamentally weak case that will open up a can of worms politically, and you can expect more top officials to face prosecution.

  • What’s really happening here is the same thing that Democrats have been focused on for six years: get Trump at all costs.

  • House Speaker Kevin McCarthy says DA Bragg crossed a line here and clearly did this for political reasons ahead of the 2024 election.

The indictment of Donald Trump by Manhattan DA Bragg leaves America with this legal puzzle Jonathan Turley, Fox News Opinion: “We are all waiting to see the text of the indictment to confirm the basis for this unprecedented act. But history in this case -- and in this country -- is not on Bragg's side. If that is still the basis of Thursday’s indictment, Bragg could not have raised a weaker basis to prosecute a former president. Trump’s Getting What’s Coming To Him, but Tread Lightly

  • This is not the strongest legal case, and there are risks in a failed prosecution, which would further Trump’s claims of martyrdom.

  • After years spent trashing norms and precedents of democracy, decorum, and the law, it’s appropriate Trump would be indicted.

  • Former House Speaker Nancy Pelosi says Trump has a chance to prove his innocence – a right she hopes he peacefully respects.

The Trump indictment is a poor test case for prosecuting a former president” Editorial Board, Washington Post: “Donald Trump deserves the legal scrutiny he’s getting... Yet of the long list of alleged violations, the likely charges on which a grand jury in New York state voted to indict him are perhaps the least compelling. There’s cause for concern, and caution, ahead. … Breaches of campaign finance law undermine democracy and deserve to be taken seriously. Yet the potential downsides of indicting Mr. Trump ought to be taken seriously, too. … A failed prosecution over the hush-money payment could put them all in jeopardy, as well as provide Mr. Trump ammunition for his accusations of ‘witch hunt’ … Public perception and political strategy shouldn’t dissuade a district attorney from bringing a solid case, but neither should they persuade him to bring a shaky one. This prosecution needs to be airtight. Otherwise, it’s not worth continuing.”

As the news of the indictment shows, they do. A pattern of disregard for the law often leads to a criminal indictment, and that is the outcome Mr. Trump now faces. Federal and state prosecutors were right to set aside concerns about political fallout, or reverence for the presidency… Mr. Trump completely transformed the relationship between the presidency and the rule of law, often asserting that a president was above the law. So it is appropriate that his actions as president and as a candidate should now be formally weighed by judges and juries, with the possibility of criminal penalties on the line.”

Most Say Prosecution Is Political, but Also That Charges Are Disqualifying

Polling conducted in recent weeks found the majority (54%) of all respondents believe this prosecution of Trump is “politically motivated” – including 80% of Republicans and 32% of Democrats (Reuters/Ipsos).

A separate survey determined a majority (57%) believe criminal charges should disqualify Trump from running for office, something most Democrats (88%) and Independents (55%) agree with. But 75% of Republicans disagree with that statement.

In that poll, 73% of Republicans said Trump has had a positive impact on the party, while 20% said his impact has been negative (Quinnipac University).
