MEDIA

Outfoxed

On Tuesday, multiple outlets began reporting that Fox News had agreed to a $787 million settlement with Dominion Voting Systems, avoiding a trial for defamation. This results from claims made during Fox News broadcasts, in which it was suggested Dominion's voting machines swayed the 2020 election.

Reporting from The Right: Fox News, Dominion Voting Systems settle defamation lawsuit (New York Post)

From The Flag: A jury had been seated and the trial would have seen CEO Rupert Murdoch and top Fox News TV hosts testify. With this settlement reached instead, Dominion's CEO John Poulous said outside of court, “Fox has admitted to telling lies.”

LEFT-LEANING SENTIMENT

That's Not Journalism, But This Is Definitely Business

  • While the payout is not insignificant, this deal is definitely a win in the broader war for Fox News, and Dominion was always looking to make the best business decision.

  • This settlement has denied the media landscape a chance to expose more about the lies swimming within Fox News.

  • The last-minute agreement makes clear just how sticky a situation Fox was headed for if the trial did occur.

Fox News Lost the Lawsuit but Won the War David A. Graham, The Atlantic: "For Fox, the result is costly but bearable. Documents produced in discovery in the case show that Fox saw the aftermath of the election as an existential threat, as members of its audience defected to competitors. Today, Fox’s primacy within right-wing media has been restored and those competitors have faded. The network lost the lawsuit, but it survived and won the war. Dominion’s choice to settle comes as a great disappointment to many critics of Fox, and is also probably a smart financial decision. For the critics, this case was about democracy and disinformation and provided an opportunity to hold Fox accountable for years of broadcasting hogwash. For Dominion, it was primarily about business. No matter how lofty the language its spokespeople used, the company didn’t sue to fix the American media landscape."

For Some Reason, Dominion Settles With Fox in Defamation Lawsuit Over Election Lies ‍Prem Thakker, The New Republic: "After a months-long legal battle between Dominion Voting Systems and Fox Corporation, it all ended in a poot. ... The settlement nips away what may have been an unprecedented trial process that would’ve brought an array of insiders—Fox hosts, executives, and others—to take the stand. The day was slated to be one that opened up the possibility for more revelations into Fox and the lies swarming within it. Instead, the promise of further accountability for the network slowly, and then all at once, fizzled away. With the settlement, Dominion decided that the short-term win was worth more than continuing the battle against one of the most crooked 'news' agencies in the business. That Rupert Murdoch’s Fox was willing to fork over so much cash gives a hint at what more still was left to be exposed."

RIGHT-LEANING SENTIMENT

Fox News Forced To Pay Up Big, But Liberals Down Bad

  • It's a good thing this case was settled, because while Fox News made mistakes they're now paying for, a trial and verdict would have been uncertain.

  • Democrats in the news media are once again crying about "democracy" and ignoring the fact that Fox News took a big financial hit here.

  • If Fox News can be forced to pay money due to claims about the election, shouldn't other outlets owe cash for lies about Russian collusion, COVID, and other topics?

Fox News settlement is the best result for everybody Quin Hillyer, Washington Examiner: "A bad precedent could have been set if the case had reached a verdict for either side. Without a settlement, there was almost no possible outcome that would have avoided great mischief down the line. ... Fox was wrong in how it presented the topic of then-President Donald Trump’s lies that the 2020 election was stolen from him. Deeply, unethically wrong. Almost every person who worked for Fox knew the claims of Trump and his advisers were bogus. Yet they continued to put on the air the advisers and lawyers so Team Trump could keep making those false claims, with barely a peep of challenge from Fox’s on-air hosts. ... If, after a full trial and likely appeals all the way to the Supreme Court, Fox had escaped without punishment, then unscrupulous media outlets far and wide would have taken the result as a green light for pernicious behavior."

CNN Is Furious That Fox News Settled the Dominion Lawsuit out of Court ‍Bonchie, RedState: "The huge settlement was the result of figures going on the network after the 2020 election, accusing Dominion machines of being used to rig the election. That evidence, largely pushed by figures like Sidney Powell, who promised the 'Kraken,' never emerged. You’d think nearly a billion dollars in damages would be enough to satiate, but CNN is really, really upset that this ended up not going to trial. Oliver Darcy and Alyson Camerota took to the airwaves in the aftermath and rhetorically shook their fists at the sky. ... It feels pretty weird to be dunking on CNN given that Fox News did actually take a massive blow here. $787.5 million is a ton of money, even for a large, national news outlet. Yet, the hosts over on the liberal network are just so absurd that they always manage to outpace reality."

Fox News: Most Trusted? Depends Who You Trust

Newspaper ads, paid for by Fox News in the days before the trial was set to begin, quoted data from YouGov, which said of "TV networks most trusted for news," Fox News came in number one at 41%.

The chart included ABC News (24%), CNN (22%), CBS (22%), NBC News (21%), and MSNBC (18%).

But analysis from the Washington Post maintains this is a misleading way of looking at that data, given how conservatives and progressives take in news. It argues that, because more right-leaning individuals gravitate toward Fox News, their numbers are inflated, while those on the left split their loyalties among multiple outlets.
