The Top Argument From The Left: Trump tried to block Jack Smith’s immunity brief. It backfired., Glenn Kirschner, MSNBC: “U.S. District Judge Tanya Chutkan is about to wade into uncharted legal waters, deciding which of Donald Trump’s alleged election subversion crimes are official acts of an American president and hence at least presumptively immune from prosecution. The Supreme Court directed Chutkan to undertake this unprecedented litigation by creating out of whole cloth a doctrine of criminal immunity for a president’s ‘official acts.’ On Tuesday, Trump’s lawyers made a last-ditch attempt to prevent this maiden legal voyage from setting sail. On Wednesday, that attempt backfired, as a brief from special counsel Jack Smith's team with new evidence was made public. To comply with the Supreme Court’s command, Chutkan needs to see all the evidence of Trump’s conduct on and around Jan. 6, 2021. Last week, Smith filed the lengthy motion, which laid out Trump’s conduct as the basis of the four charges in his criminal indictment. There is also an even lengthier appendix providing the evidence (e.g., grand jury transcripts, FBI write-ups of witness interviews and the like) supporting the narrative laid out in the motion.”

If the ride felt bumpy so far, the next month promises heavier turbulence. Losing campaigns save their most desperate moves for the last month before Election Day, trying to deploy an October surprise that will so shock their opponents’ supporters that they will suddenly switch sides. But no one with a calendar is surprised by the release of Special Counsel Jack Smith’s failed filing on former President Donald Trump, unsealed Wednesday by U.S. District Court Judge Tanya Chutkan. Yawn. The purpose of the filing is to ask the court to declare that Trump does not have presidential immunity for his actions on and related to Jan. 6. Trump Trial Timing: Public Division
Polling from earlier in the year showed public opinion was divided on when Trump’s trials should take place, given that it’s an election year. For the federal election interference and Jan. 6 trial, 41% of Americans believe it should begin before the 2024 election, 22% prefer it to happen afterward, and 21% think it should be up to the judge. Similar sentiments apply to the Georgia election case, with 40% favoring a pre-election start and 22% preferring a post-election trial (YouGov).
