The Top Argument From The Right: Supreme Court Allows Emergency Abortions in Idaho but Leaves Big Questions Unresolved, Laura Kusisto, The Wall Street Journal: “Since the court overturned Roe v. Wade two years ago, ending federal protections for abortion, the inability of women in some states to access abortions in medical emergencies has emerged as a top issue, shifting public opinion on abortion rights and galvanizing political opposition to bans on the procedure. The Supreme Court’s nondecision, in which a majority voted to dismiss the case as ‘providently granted,’ will do little to end that debate or provide clarity to doctors struggling with how to interpret lifesaving exceptions to abortion bans. By stepping back from the case, the justices reinstated a lower-court order allowing doctors broad discretion to perform abortions in Idaho in medical emergencies. The action won’t change anything for physicians nationwide. The Supreme Court had two abortion cases on its docket this term. It ended up deciding nothing of substance in either of them. The other case involved a challenge to decisions by the Food and Drug Administration to expand access to the abortion pill mifepristone, which is used in the majority of abortions in the country. Earlier this month, the justices said the plaintiffs, antiabortion medical associations and physicians, didn’t have standing to bring the suit.”

Not a Win for Abortion Access

The Top Argument From The Left: The Supreme Court’s new abortion decision, explained, Ian Millhiser, Vox: “Though the Court has seemingly splintered into four separate concurring and dissenting opinions, none of which garnered a majority of the justices’ support, five justices apparently decided that the Court was wrong to take up this case using an expedited process that bypassed an intermediate appeals court. The leaked document does contain some good news for abortion rights advocates. Last January, the Court temporarily blocked a lower court decision, which held that the state of Idaho cannot enforce its strict abortion ban against patients who need an abortion to save their life or to ward off catastrophic health consequences. In the leaked document, six justices voted to reinstate the lower court’s order — at least for now — which means that Idaho patients who require medically necessary abortions will no longer need to be airlifted to other states. Still, the primary effect of the decision, assuming it closely resembles the leaked draft, will likely be to punt the final resolution of this case until after the election. That means that patients outside of Idaho — who may have been hoping a decision in this case would set a precedent requiring ER doctors across the country to follow the federal law requiring care in the event of an emergency — may not be able to obtain abortion care that they need to save their life or to ward off very serious health consequences.”

The CDC recently published a report explaining that in 2021, 625,978 legally induced abortions were reported from 48 areas. Among 47 areas consistently reporting from 2012 to 2021, there were 622,108 abortions, with a rate of 11.6 abortions per 1,000 women aged 15-44, and a ratio of 204 abortions per 1,000 live births. Compared to 2020, the number of abortions, abortion rate, and abortion ratio each increased by 5%, 5%, and 4%, respectively. From 2012 to 2021, these metrics decreased by 8%, 11%, and 1%, respectively (CDC).
