Arrest Incoming?

Former President Trump has said he expects to be arrested today in New York City, concerning a $130,000 payment made to porn star Stormy Daniels. Trump has admitted he reimbursed his former attorney Michael Cohen for that payment, but denies it was to cover up an affair.

From the Flag: The Manhattan District Attorney has pursued this case as a violation of campaign finance law. The argument is that the payment was an undisclosed contribution to Trump’s campaign – to keep the affair from impacting his image prior to the 2016 election. Here’s more from both sides.

LEFT-LEANING SENTIMENT

Get Ready for the “Deep State” Defense, and Potential Unrest

  • If Trump is arrested, Republicans will say it’s another example of the “deep state” going after the former president.

  • Trump is sure to claim martyrdom as a result of this case, but that will only get him so far.

  • Trump should know his base better than anyone, so it is deeply alarming he’d call for protests following January 6.

“Could a Criminal Indictment Help Trump's 2024 Campaign?” Ed Kilgore, New York Magazine: “Normally, you’d guess that a criminal indictment would be an instant disqualifier for a presidential candidate. But now that a Trump indictment seems likely in the days ahead… There is no reason to assume that a criminal indictment will change any minds among the MAGA faithful. Trump clearly benefited from both of his congressional impeachments among rank-and-file Republicans. And Trump’s base has been instructed for years that the ‘deep state,’ with its tentacles extending into every branch of government, is determined to remove him from the picture in order to resume its persecution of ‘patriots’ and its globalist destruction of the US. None of the cases that could lead to charges against Trump will shock or offend his supporters. The Stormy Daniels ‘hush money’ story… and the probable grounds for criminal charges are relatively complex and obscure.”

“The Curtain Rises on Trump's Legal Dramas” David Remnick, The New Yorker: “The legal and political sources I’ve spoken with tell me that… the Stormy Daniels case is the least significant and the weakest one facing Trump. Bragg will have to prove that the hush money provided to Daniels to cover up their affair amounts to felonious election fraud. A caveat: if indeed an indictment is coming, we do not know the specifics. … Trump is shrewd enough to reap political gain if he is indicted this week in New York. Just as he played the martyr when the FBI recovered classified files from Mar-a-Lago or when he was investigated, repeatedly, in Congress, he will once more complain that he, like his loyal followers, is the victim of élite disdain and persecution. But this strategy of martyrdom is unlikely to prevail. Time will run out for Trump, be it in Georgia, at the Department of Justice, or, if it goes on that long, at the ballot box.”

A Weak Case With Politics at Its Core, as Well as Questionable Motives

  • Manhattan DA Alvin Bragg is pursuing a weak case that could cause people to lose confidence in the legal system.

  • This is a political move, designed to satisfy the news media and leftist Democrats.

  • Democrats continue to elevate Trump’s status, either because they are blinded by hatred, or fear DeSantis.

“Alvin Bragg's Political Charge Against Donald Trump” Editorial Board, Wall Street Journal Opinion: “It’s impossible to overstate Mr. Bragg’s bad judgment here. Perhaps the local Democratic DA has discovered some new proof of criminal behavior. But based on the public evidence so far, he would be resurrecting a seven-year-old case that even federal prosecutors refused to bring to court. … A key prosecution witness would be Michael Cohen… an admitted felon. Mr. Trump might claim in his defense that his payments were made to shield the affair from his wife. … Proving intent to break the law will not be easy. … The prosecution of a former President who is again a candidate for the White House is inherently fraught with political ramifications. A wise prosecutor must consider the potential harm to confidence in the rule of law in bringing a prosecution that at least half the country will deem political.”

“Get Ready for the Made-for-TV Trump Prosecution” Jonathan Turley, The Hill Opinion: “Trump faces serious legal threats in the ongoing Mar-a-Lago investigation. But the New York case would be easily dismissed outside of a jurisdiction like New York, where Bragg can count on highly motivated judges and jurors. Although it may be politically popular, the case is legally pathetic. Bragg is struggling to twist state laws to effectively prosecute a federal case long ago rejected by the Justice Department against Trump… It is extremely difficult to show that paying money to cover up an embarrassing affair was done for election purposes as opposed to an array of obvious other reasons, from protecting a celebrity’s reputation to preserving a marriage. That was demonstrated by the failed federal prosecution of former presidential candidate John Edwards on a much stronger charge of using campaign funds to cover up an affair.”

Just How Serious Is Stormy?

A recent poll from YouGov asked respondents “how serious an issue” is the $130,000 payment made to Stormy Daniels, to which 53% of Democrats said “very serious.” Just 15% of Republicans said the same.

Meanwhile, 1 in 4 Republicans say “not serious at all,” compared to only 5% of Democrats who feel the same way.

Still, Trump’s poll numbers have been on the rise lately in comparison to his presumed chief rival, Florida Governor Ron DeSantis. Analysis from the New York Times suggests this is partly due to Trump’s attacks on DeSantis, as well as the governor not actively campaigning.
