Over the past few weeks, both mainstream outlets and tabloids alike have been chronicling the defamation case brought by actor Johnny Depp against his ex-wife Amber Heard. For context, the couple split in 2016, but have been involved in a court battle over an op-ed Heard wrote for The Washington Post in 2018. Without mentioning Depp by name, Heard described surviving domestic violence. Here's how it's been playing in the news sections:

Heard is Being Held to an Unfair Standard

  • Our desire to see a woman publicly redeem herself is often eclipsed by our greater thirst to see a woman’s public downfall. 
  • The current trial is rife with victim-blaming and misogynistic attacks by Depp's team, causing Heard to relive her abuse.
  • The case should look at how domestic violence affects both men and women. Instead, it has become a delusional, misogynistic circus.

“Pamela Anderson, Amber Heard and the Limits of the Feminist Redemption Plot” Jessica Bennett, New York Times Opinion: “It doesn’t take much effort to uncover examples of imperfect women whose lives are currently being picked over by our culture, in real time. … Last week the actress Amber Heard took the stand in a defamation trial against her. She is being sued by her ex-husband, Johnny Depp, over a 2018 opinion essay she wrote, in which she called herself a victim of domestic abuse. (Mr. Depp has denied abusing Ms. Heard and has accused her of abusing him.) The outcome of the trial is still weeks away, and there are plenty of reasons to express skepticism about either side’s narrative. And yet it is Mr. Depp’s fans who flank the courthouse daily, waving from the galley, while social media — and the trial’s livestream — is inundated with anti-Heard memes and insults, calling her a 'gold digger,' 'fake,' 'bipolar' and 'manipulative,' to the extent that she has reportedly had to hire security."

“Why do people blindly support Johnny Depp? I’ll tell you why” Charlotte Proudman, Independent: “The world sits in judgment, questioning whether Heard is a ‘real victim’. Does she look like a victim? Does she speak like a victim? Does she cry like a victim? Where are the headlines asking if Depp is a perpetrator, judging him on every move that he makes? There are no special measures in court – Depp sits there smiling, while Heard relives abuse and trauma. Depp’s lawyer is used as a pawn, a weapon to revictimise her for the world’s entertainment. The court has become a tool for a perpetrator to continue his abuse and control. What message does that send out to victims? Victims who don’t have money, fame, photos of injuries and texts threatening to harm them? How do they think they will be treated by the justice system? The court is asked to pathologize Heard as being ‘abnormal’, ‘mentally ill’ and ‘mad’.”

This Spectacle is Damaging to Victims of Domestic Abuse

  • Whatever happened shouldn’t be litigated in the court of public opinion.
  • This whole trial is a degrading spectacle, and both sides are humiliating themselves in the quest for victimhood.
  • The use of words like “trauma” have become so ubiquitous that legitimate cases of trauma are being trivialized.

“She Hit? He Hit?” Froma Harrop, Real Clear Politics: “Heard didn't help her case when she attached it to the #MeToo movement. Originating in the abuse and harassment of women in Hollywood, #MeToo did serve a purpose. But many women have exploited #MeToo as a weapon designed to extract revenge, money or publicity. Or to stop an honest conversation about an interaction that was, at bottom, messy. … Theirs was obviously a tempestuous marriage. But it is also safe to question Heard's motives in making this a 'women must be believed' story. Women don't have to be believed. They should be listened to, yes. But then, so should men. … What [Heard’s] accusations have done, Depp claims, is hurt his career. Heard complains that this sordid story has hurt hers. Both could be right, but then again, careers in Hollywood can go up or down for various other reasons -- age, changing tastes, good or bad reviews. … The court of public opinion is the wrong place to do this.”

“Depp vs Heard is an ugly, degrading spectacle” Ella Whelan, Spiked: “For Heard and Depp, egged on by the media, the court cases have become part of an ongoing battle to be crowned the chief victim in the court of public opinion. … It makes for a grim spectacle. Most people will find it very difficult to judge who is more wronged here. The sordid revelations about what sounds like a toxic marriage paint both sides in a sad, miserable light. There have been tales of Depp’s severed finger, of Heard deliberately soiling their bed, of their heavy drinking and drug abuse. Neither party comes out of this well. Indeed, one clinical psychologist, who testified earlier this week, described the relationship as one of ‘mutual abuse’. Yet too many in the media are determined to pick a side, and present one as the victim and the other as the aggressor. The coverage has transformed a messy, unpleasant relationship into a morality play.”

If You’re Watching, You Probably Believe Depp

While the story isn’t top-of-mind for many Americans, those who are paying attention seem to believe Johnny Depp. According to Rasmussen Reports, 40% of American adults believe Depp is probably telling the truth. Only 10% think Heard is telling the truth, while 51% are undecided.

An interesting social media phenomenon has also emerged. Nearly 11% of all Twitter accounts participating in the discourse surrounding this trial are inauthentic, new research shows. The majority of those inauthentic accounts are supportive of Heard, while most authentic accounts are supportive of Depp, according to an analysis of 2,300 Twitter profiles conducted by Cyabra.
